Terms and Conditions

Welcome to CraftPrompt Studio ("CraftPrompt," "we," "us," or "our"), accessible at craftprompt.studio. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and CraftPrompt Studio governing your access to and use of our website, applications, and services (collectively, the "Service").

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Cookie Policy, which are incorporated herein by reference.

If you do not agree to these Terms, you must not access or use the Service. Your continued use of the Service after any modifications to these Terms constitutes your acceptance of such modifications.

Age Requirement. You must be at least 18 years of age to create an account and use the Service. By registering, you represent and warrant that you meet this age requirement.

Account Information. When creating an account, you must provide accurate, current, and complete information, including your name and email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

One Account Per Person. Each individual may maintain only one account. Creating multiple accounts to circumvent usage limits or for any other purpose is prohibited and may result in the termination of all associated accounts.

Account Security. You agree to notify us immediately at hello@craftprompt.studio if you become aware of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account credentials.

CraftPrompt Studio is an AI-powered prompt engineering platform that provides the following capabilities:

• Prompt Generation: Users describe scenes or concepts in natural language, and our AI generates optimized prompts tailored for various generative AI models, including but not limited to Midjourney, Flux, Seedance, Kling, Luma, Minimax, Veo, Runway, and others.
• Image Generation: Users can generate images directly within the platform using integrated AI models.
• Video Generation: Users can generate videos directly within the platform using integrated AI video models.
• Reference Image Upload: Users can upload reference images to guide prompt and content generation.
• History and Gallery: Users can view and manage their previously generated prompts, images, and videos.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

4.1 Available Plans

CraftPrompt offers multiple subscription tiers, including Free, Pro, Creator, and Enterprise plans. Each plan provides different levels of access, including varying daily limits for prompt generation, image generation, and video generation. Current plan details and pricing are available on our Pricing page.

4.2 Free Plan

The Free plan provides limited access to the Service, including up to 20 prompts per day, 2 video generations per day, and 5 image generations per day. No payment information is required for the Free plan.

4.3 Paid Subscriptions

Paid subscriptions are billed on a recurring basis (monthly or annually, depending on the plan selected) through our payment processor, Stripe. By subscribing to a paid plan, you authorize CraftPrompt to charge your payment method on a recurring basis until you cancel your subscription.

4.4 Auto-Renewal

All paid subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription fee for the applicable plan at each renewal.

4.5 Cancellation

You may cancel your subscription at any time through your account's Billing page. Upon cancellation, you will retain access to your paid plan features until the end of the current billing period. After the billing period ends, your account will revert to the Free plan.

4.6 Refunds

Payments are generally non-refundable. However, if you believe you have been charged in error, please contact us at hello@craftprompt.studio within 14 days of the charge, and we will review your request on a case-by-case basis.

4.7 Price Changes

We reserve the right to change subscription prices at any time. If we change the price of your subscription, we will notify you at least 30 days in advance via email. The new price will take effect at the start of your next billing period following the notice.

5.1 Your Content

"User Content" refers to any text, scene descriptions, reference images, or other materials that you submit to the Service. You retain all rights to your User Content. By submitting User Content, you grant CraftPrompt a non-exclusive, worldwide, royalty-free license to use, process, and transmit your User Content solely for the purpose of providing and improving the Service.

5.2 Generated Content

Prompts, images, and videos generated by the Service based on your input ("Generated Content") are yours to use, subject to the terms of the underlying AI models and any applicable third-party terms. We do not claim ownership of Generated Content. However, you acknowledge that similar or identical content may be generated for other users who provide similar inputs.

5.3 CraftPrompt Intellectual Property

The Service, including its design, features, code, logos, trademarks, and all other proprietary materials, is owned by CraftPrompt Studio and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service other than the limited right to use it in accordance with these Terms.

5.4 Feedback

If you provide us with any feedback, suggestions, or ideas regarding the Service, you grant us an unrestricted, perpetual, irrevocable, royalty-free license to use such feedback for any purpose without obligation or compensation to you.

You agree not to use the Service to:

• Generate, distribute, or facilitate the creation of content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable under applicable law.
• Generate content depicting child sexual abuse material (CSAM) or the exploitation of minors in any form. This is strictly prohibited and will result in immediate account termination and reporting to relevant authorities.
• Generate content intended to deceive, defraud, or mislead others, including deepfakes or disinformation.
• Infringe upon the intellectual property rights of any third party, including generating content that replicates copyrighted or trademarked material without authorization.
• Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the Service or any underlying AI models.
• Use automated scripts, bots, or other tools to access the Service in a manner that exceeds reasonable use or circumvents rate limits.
• Resell, redistribute, or sublicense access to the Service without our prior written consent.
• Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.
• Attempt to gain unauthorized access to the Service, other users' accounts, or any related systems or networks.
• Use the Service in any manner that violates applicable local, national, or international law or regulation.

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this Acceptable Use Policy, including removing content, suspending or terminating accounts, and reporting to law enforcement where warranted.

No Guarantee of Accuracy. The prompts, images, videos, and other content generated by the Service are produced by artificial intelligence systems. We do not guarantee the accuracy, completeness, quality, or suitability of any generated content for any particular purpose.

Third-Party Model Usage. Prompts generated by the Service are intended for use with third-party generative AI models (such as Midjourney, Flux, Seedance, and others). CraftPrompt is not responsible for the output produced by these third-party models when using our generated prompts, nor for any consequences arising from such use.

Your Responsibility. You are solely responsible for reviewing all generated content before using, sharing, or publishing it. You are also responsible for ensuring that your use of generated content complies with applicable laws, regulations, and the terms of service of any third-party platforms where you use such content.

No Professional Advice. Generated content does not constitute professional, legal, medical, financial, or any other form of advice. You should not rely on generated content as a substitute for professional judgment.

The Service relies on and integrates with the following third-party services to deliver its functionality:

• Anthropic (Claude API) — Used for AI prompt generation.
• OpenAI (GPT-4o) — Used as a fallback for prompt generation.
• Google (Gemini) — Used as a fallback for prompt generation and for image generation.
• xAI (Grok) — Used as a fallback for prompt generation.
• fal.ai — Used for video generation across multiple models (Seedance, Kling, Luma, Minimax, Veo, Runway).
• Stripe — Used for payment processing and subscription management.

Your use of the Service may be subject to the terms, conditions, and privacy policies of these third-party providers. We encourage you to review their respective terms. CraftPrompt is not responsible for the practices, availability, or performance of any third-party service.

When you use features that involve these third-party services, certain data (such as your scene descriptions or prompts) may be transmitted to these providers in order to fulfill your request. Please refer to our Privacy Policy for more details on data sharing with third parties.

Each subscription plan includes daily usage limits for prompt generation, image generation, and video generation. These limits reset every 24 hours. Current limits for each plan are displayed on the Pricing page and within your account dashboard.

We reserve the right to implement additional rate limits or usage restrictions to ensure fair access for all users, maintain system performance, and prevent abuse. Excessive or unusual usage patterns may result in temporary throttling or account review.

10.1 Termination by You

You may delete your account at any time through your Profile settings. Upon account deletion, all your personal data, generated content (prompts, images, videos), and associated files will be permanently deleted from our systems in accordance with our data retention practices.

10.2 Termination by Us

We may suspend or terminate your account, with or without notice, if we reasonably believe that you have violated these Terms, engaged in fraudulent or illegal activity, or if your continued use of the Service poses a risk to the Service, other users, or third parties.

10.3 Effect of Termination

Upon termination, your right to access and use the Service will immediately cease. We are not obligated to retain any of your data following account termination, and all associated content will be subject to cascade deletion. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification obligations.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CRAFTPROMPT DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, reliability, or completeness of any content generated by the Service. Your use of the Service is at your sole risk.

Some jurisdictions do not allow the exclusion of certain warranties. In such jurisdictions, the above exclusions shall apply to the fullest extent permitted by applicable law.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CRAFTPROMPT, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED EUROS (EUR 100).

These limitations apply regardless of the legal theory upon which the claim is based, whether we have been advised of the possibility of such damages, and even if a limited remedy set forth herein is found to have failed its essential purpose. Some jurisdictions do not allow certain limitations of liability; in such jurisdictions, our liability shall be limited to the fullest extent permitted by law.

You agree to defend, indemnify, and hold harmless CraftPrompt Studio, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of or access to the Service;
• Your violation of these Terms;
• Your violation of any third-party right, including any intellectual property, privacy, or proprietary right;
• Any content you submit to or generate through the Service;
• Your use of generated prompts, images, or videos in third-party tools or platforms.

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable laws of the member state in which CraftPrompt Studio is established, without regard to conflict of law principles.

For users residing in the European Union, nothing in these Terms shall deprive you of the protection afforded by provisions that cannot be derogated from by agreement under the law of your country of habitual residence, including your rights under the General Data Protection Regulation (GDPR) and applicable consumer protection legislation.

Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the parties are unable to resolve a dispute through negotiation within 30 days, either party may submit the dispute to the competent courts. EU consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email and/or by posting a prominent notice on the Service at least 30 days before the changes take effect. The "Last updated" date at the top of these Terms will be revised accordingly.

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree with the revised Terms, you must stop using the Service and may delete your account.
